Kubota Holdings Europe owns the brands “Kubota”, “Kverneland”, “Vicon”, “FEDE” and “ROC”. The brands “Kubota”, “Vicon”, “FEDE”, “ROC” and “Kverneland” are together referred to as the “Brands”.

These terms of use constitute a binding agreement between Kubota Holdings Europe and you. Please read these terms of use carefully before using the Website. By accessing and/or using the Website, it is deemed agreed that you have voluntarily accepted these terms of use and to be bound by these terms of use, conditions and notices contained or referenced herein. If you do not agree to these terms of use, please do not use the Website. If you choose to access any password protected areas of the Website, you may be required to electronically sign and be legally bound by additional terms and conditions.

Accordingly, those users who choose to access the Website from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

These terms of use are drawn up in English and are, at the discretion of Kubota, translated in several languages for your convenience. In case of inconsistencies, discrepancies or difficulty of application or interpretation between the English version and the translated versions, the English version shall prevail.

APPLICABLE LAW AND DISPUTE RESOLUTION

These terms of use and any action related thereto shall be governed, controlled, interpreted and defined by and under the laws of the Netherlands, without regard to the conflicts of laws provisions thereof.

Any disputes that may arise as a result of these terms of use shall be submitted to the exclusive jurisdiction of the competent court within the jurisdiction of the District Court in Amsterdam, the Netherlands. Notwithstanding the foregoing, We are also entitled to bring the dispute or action before the court where the defendant has its registered offices. You expressly waive any right to participate in or bring class-wide, collective, or representative claims.

MODIFICATION OF THE TERMS OF USE

Kubota Holdings Europe reserves the right to amend these terms of use at its sole and absolute discretion from time to time. Such change shall be effective when posted on the Website or effective as soon after posting as permitted under applicable law.

There is no joint venture, partnership, employment or agency relationship created between you and Us as a result of these terms of use or use of the Website. You agree that these terms of use will not be construed against Us by virtue of having drafted them.

You hereby waive any and all defences you may have based on the electronic form of these terms of use and the lack of signing by the parties hereto to execute these terms of use.

The failure of Kubota Holdings Europe to enforce any provisions of these terms of use or respond to a breach by you or other parties shall not in any way waive its right to enforce subsequently any terms or conditions of these terms of use or to act with respect to similar breaches.
